QR CODE game contest

ARTICLE 1 – CONTEST ORGANIZER:
YKF, a company trading under the name of “YELLOWKORNER” (hereafter referred to as the “Organizer”), a limited liability corporation with a supervisory board of directors, having a paid up share capital of €143 382,92, registered with the Paris Register of Companies under company number B 489 809 186, and headquartered at 84 rue Beaubourg, 75006 PARIS, is organizing a contest entitled “QR CODE game contest” to run from March 1st, 2022. until March 1st 2026 (hereafter referred to as the “Contest”).

ARTICLE 2 – CONTEST PERIODS:
The contest will take place from March 1rd, 2022 at 8 a.m. until March 1th, 2026 at 11:59 p.m., period during which candidates will register. The Organizer reserves the right, without liability, to cut short, extend, cancel or change the operation of the Contest at any time due to the occurrence of an event of force majeure or if otherwise so required due to external circumstances.

ARTICLE 3 – ENTRANTS:
The Contest is open to any natural person, having attained the age of majority and having full capacity, who is a resident of France, Germany, Belgium, Sweden, Spain, Switzerland, the Netherlands, United-Kingdom, Italy, the United States or Canada, excluding members of the Organizer’s personnel, service providers involved in the operation of the Contest, and their families. Entry in the Contest is limited to one entry per person (having the same name, postal and/or e-mail address). Entry in the Contest implies the entrant’s unreserved acceptance of these Rules.

ARTICLE 4 – METHOD OF ENTRY:
To participate in the Contest, each participant must simply scan the QR code present in the Organizing Company's galleries and submit at least his or her email address. The participant is offered the opportunity to subscribe to the newsletter of the organizing company (check box when filling out the game form). The participant is then automatically entered into the Contest when he/she validates his/her form. The selection of the winner will be realized through a random draw, which will take place every month and will determine 5 winners. The selection of the winner will be done randomly by the YellowKorner team. No inaccurate or incomplete registrations shall be processed. The Organizer reserves the right to exclude any contact receiving suspicious or fraudulent registered. The Organizer reserves the right to undertake relevant verification of the entrant’s compliance with these Rules and to invalidate the entry of any entrant who has engaged in any abuse or otherwise breached any applicable laws or regulations in force in the territory of France, without thereby being obliged to verify the entries of all entrants systematically. Any false or inconsistent statement, or any breach of these rules by an entrant shall lead to the immediate exclusion of that entrant from the Contest.

ARTICLE 5 – THE PRIZE:
The Contest is awarded with 5 photographs in 40x50cm format, with a value of 84€ each month. The winner shall be notified by electronic mail, sent to the e-mail address specified in the entry form, on the day that the winner is selected. Any incomplete or inaccurate personal details shall void the entry and shall prevent award of the prize, in which case the prize that had been awarded to the winner shall be made available for further award. The Organizer shall not be held liable in the event of non-receipt of the electronic mail notifying the winner of the prize, or as a result of an error in the e-mail address provided by the entrant on the entry form, in the event of failure of the internet service provider, or in the event of any internet outage or for any other reason whatsoever. Any prize that remains unclaimed one week from the date of closure of the Contest shall be deemed to remain the property of the Organizer. The prize given to the winner shall not give rise to any claim of any kind, including for a cash equivalent (whether in whole or in part) nor for any exchange or replacement against another prize of any value whatsoever or for any reason. Finally, the Organizer reserves the right, without liability, to replace the prize with another prize of similar kind and equivalent value upon the occurrence of any event of force majeure or other event outside its control.

ARTICLE 6 – REIMBURSEMENT OF ENTRY FEES AND POSTAGE COSTS/
In order to receive a refund of any entry fee or postage costs incurred as a result of entering the Contest, a written request may be sent to the Organizer’s address at 84 rue Beaubourg, 75006 PARIS, France before March 1th, 2023 at midnight (as demonstrated by the postmark), providing bank details and specifying, in a legible manner, the following information: family name, given name, and complete address. Requests for reimbursement made by telephone shall not be accepted. Reimbursement of entry fees to the Contest shall be calculated as the cost of the internet connection, based on a fixed cost of €0.21 per entrant. Only persons using an account charged for time spent connected shall be entitled to receive a refund. No reimbursement shall be provided for entries made using a cellphone or smartphone. Competition entrants who do not pay for their connection by the unit will not be reimbursed, due to there being no additional cost invoiced as a result of their entering the competition. For reimbursement of postage costs: the postage costs associated with a request for reimbursement of contest entry fees will be refunded at the slowest mail tariff applicable in France, based on a 20g letter. The Organizer will only accept a single request for reimbursement per household. Reimbursement will be made by bank transfer within approximately eight weeks from receipt of the request. Any request that is incomplete, illegible, fraudulent, missing a stamp or with a stamp of insufficient value, out of time, or sent to or from the wrong geographic area, shall be void.

ARTICLE 7 – NOTICE OF THE CONTEST
1. NOTICE OF THE CONTEST

The Contest shall be announced on the YellowKorner galleries. The Rules may be accessed on YellowKorner’s website at: /en/QR-CODE-CONTEST-Cp004.html. These Rules are available free of charge to any person who requests them from the Organizer (see Article 6).
2. Intellectual Property Rights

Entrants to the Contest undertake to agree, without any claim to any remuneration or reward, to the publication, distribution and broadcast of their identity in any medium or any format for the purposes of providing information, undertaking promotions, or media relations in connection with the Contest. They further undertake, on the same basis, to assign free of charge to the Organizer the rights to use their image, their family name and given name(s) in connection with publication, distribution and broadcast of promotions, marketing and communications relating to the Contest. The Organizer undertakes to refrain from passing on details of entrants to third parties without their consent.
3. Protection of personal data

Entry to the Contest requires entrants’ personal data to be provided. Collection of personal data is required to confirm entry to the Contest. Personal details provided by entrants enable the Organizer to send news and content relating to YellowKorner by e-mail, and by entering the Contest, entrants agree to receive such communications. This data may also be used by the Organizer to perform tasks related to the management of the Contest (such as processing entries, awarding prizes, and announcing the results). Personal details provided by entrants may be processed electronically. Entrants may request to be excluded or removed from the relevant database at any time. In accordance with the French Law on Computing and Personal Freedom of January 6th, 1978, as amended (particularly Article 27 thereof) any person photographed by consent has the right to access, amend, or retrieve personal data relating to him or herself by sending a written request to the Organizer at the address provided above (see article 1).

ARTICLE 8 – ACCEPTANCE OF THESE RULES
Any entry to the Contest implies acceptance, without reservation or amendment, of these Rules in their entirety. Any entry shall be subject to the Organizer’s final adjudication in relation to any dispute concerning the interpretation and/or application of these Rules.





These Rules shall be subject to French law. In respect of any dispute directly or indirectly arising from the Contest, entrants agree that they shall be subject to French laws in force from time to time.
